My boyfriend and I are splitting. We have a young son and own a house. He has agreed to let me buy him out of the house. We are now working out the custody/child support arrangement. We planned on just having an att create an agreement that we both agreed with and not going thru the courts. My fear is, if he stops paying child support, then I will not be protected by the state since we never went thru the courts. Plus he may leave the country for work, which worries more. If he stops paying and leaves the country, then what do I do???How binding is a custody/child support agreement which doesn't go thru the courts? Will the state protect/help me if he doesn't abide by the terms as they would if it was court enforced?

It is not binding unless a court approves it. Any attorney that creates the agreement should advise you to have the court approve it.
