Legal Question in Family Law in Florida

HRS/CPT children removal from home

What rights do we have for children taken away by HRS/Cpt under false charges and minor charges. Hearing is scheduled for 30 days and kids are in their custody. They just came and took kids without leaving any paperwork of what charges were being filed. Never left or said where and when peliminary hearing was scheduled the next day,had to make numorus calls to find out. Some of the charges were so ridiculous such as a saggy diaper and never bathed. They refused sit down and listen to any explanation of any charges they brought up.

Re: HRS/CPT children removal from home

Somewhere there is paperwork explaining the charges and actions of the DCF. Dept. of Children and Families. It is no longer called HRS. You should contact the local office, find out who the investigator or caseworker is, and demand to be notified and involved in the hearing which will be held, probably within 15 days of the charges. You must act promptly. You are advised to consult with a local family law attorney or agency who can help you. Prepare for the hearing with witnesses who can testify in your behalf. The court's objective is to do what is in the best interests of the children. You have to show the court that your children should be living with you and that they are well cared for. DCF probably acted on the complaint or information from another party; their Child Protective Unit is required to act quickly. If you want to keep your children, you are advised to actly quickly with the help of a local attorney.
