Legal Question in Family Law in Florida

My husband had an affair and a baby resulted from it. After a lot of marriage counseling my husband and I have since recinciled. He pays child support for the child but agreed between the mother and him to not have contact with the child because we have three children and wanted to move past the affair. Also the mother is since engaged and the child calls her fiancee daddy. They want her fiancee to adopt the child and for my husband to sign over rights. Do they have to be married first for us to do that? Both parties are in complete agreence that this is the best for everyone involved including the child and to not confuse the little girl if she already calls this man daddy. Also would this classify under just filling fees or is there more cost involved?

His parental rights could be terminated as part of the step-parent adoption process.

If the other couple gets married it is a lot easier for them to adopt because it is a step-parent adoption which is much easier under Florida law. Contact my office for free consultation 727-446-7659

I believe I would go with Mr. Buckely - terminate the father's rights and then if the mother wishes to allow adoption of her child by the BF - then so be it.
