Legal Question in Family Law in Florida

My husband had a affair that lasted for almost 3 years before I found out about it. I want a separation, but he refuses to move out. He makes twice as much as me and I can't afford to move out, (our house is paid for). What can I do?

In this type of situation, neither party can really be forced to move out. However, you can file for divorce and then ask for temporary exclusive use of the marital home. Given the relative financial positions of the parties, the Court may allow you to stay and force your husband to move out.
