Legal Question in Family Law in Florida

My ex husband and I have not been back to court since we were divorced to modify our custody agreement. Any issues we have had we have worked out between us. My oldest son wanted to live with his dad and I agreed to that. Soon after my husband was offered work out of state. We made an arrangement of how we would work out custody and it worked ok until now.

My ex husband's second wife left him last summer and since then my ex husband has not been thinking straight. He let a woman he met at his bowling league move in a few weeks after he was seperated. The woman has kids who also moved in. Things are not sounding good in the home. My ex says he and this woman are not dating anymore and she is moving out but it has been months.My boys have complained to their grandmother about the situation. My oldest son told me a few nights ago he almost ran away from his dad's house. I am afraid he will. My son is begging to come stay with me for a few months while his dad straightens out the situation at home. My ex says no. He told our son he could not go because he (my ex) would be too lonely. He made excuses about school and then brought up all this stuff from the past.

I really think that this time would be beneficial to my son but I do not know how I can go about making it happen for him. I really do not want to have to go to court because we might both end up with an arrangement we hate (that is why we do everything ourselves) and I don't need anything perminent just this temporary time so that his dad can have some time to work things out and he can get away from the stress.

It all depends on what your papers state. If you were given custody, then send your son a bus ticket home. If he was given custody, you will need to get a court order.
