Legal Question in Family Law in Florida

husband cheating

I found a briefcase my husband was hiding and it was full of pictures of naked women, some of them were of my sister. There are several video tapes also that I have not been able to view. What should I do? We have been married for 30 years.

NOTE: This communication is not intended as and should not be interpreted as legal advice. Rather, it is intended solely as a general discussion of legal principles. You should not rely on or take action based on this communication without first presenting ALL relevant details to a competent attorney in your jurisdiction and then receiving the attorney's individualized advice for you. By reading the "Response" to your question or comment, you agree that the opinion expressed is not intended to, nor does it, create any attorney-client relationship, nor does it constitute legal advice to any person reviewing such information, nor will it be considered an attorney-client privileged communication. If you do not agree, then stop right here, and do not read any further.

Yours is not an easy question. Forgetting the legal implications, what do you want to do? After 30 years, divorce may not be an option that you want to consider - or it may be the only option in your mind. You need to talk this out with someone you trust - and that apparently cannot be your sister. You may wish to confront your husband and discuss this or get marital counseling. If you want to end your marriage by divorce, you should immediately meet with a lawyer to review your legal rights and responsibilities.

If you choose not to act at this time, you might wish to place the briefcase in a secure place for safekeeping. Although your husband's actions are generally not important for a divorce action, you never know when something will come up that might make the possession of the briefcase desireable. At the least, you will know that he is no longer viewing the content.

Re: husband cheating

Keep the briefcase. The pictures may possibly be relevant in a future divorce action. Also, the pictures my be evidence of crimes depending on how he obtained them.
