Currently my ex husband and I are going through a custody battle. At the moment, I have primary custody of our 9 year old son. Long story short while my ex husband and i were married he had a mistress. during our last year of marriage, she got angry because i wouldn't leave my husband at the time. Therefore she started calling me a CENSORED for 6 months straight. This was 4 years ago. She called my son a CENSORED via text during that time. During our divorce case in court. I mentioned the racism, to the judge. He asked my ex if he still was seeing the girl. He lied and answered no. Unfortunately, they got married last year and I am mortified when I have to send my son to his father's during summer, spring break, and holiday visits. I have this female on a recorded tape calling me the "n" word. She left it on a voicemail, therefore she knew she was being recorded. I can't believe that my ex husband would marry her and now feel as i don't trust him. I would like to get full custody of my son. I do not want my son around her. I would like him supervised or not around his father at all. He did not pay me child support for 3 of the five years since we moved away. He has only started being a better father since this case which has only been about 6 months. Do you think i will win or at least keep my child away from her?

You have very solid legal grounds and you may be able to restrict his visitation to supervised visits. At this point, that's about all you can do unless he is abusive or the child would be in danger.
