Legal Question in Family Law in Florida

My Ex husband decided a year ago that he no longer wanted anything to do with our 12 year daughter. He has had NO contact with her in this year except for a Christmas card. She was so hurt by all of this and so very angry,but in the year of not seeing him, her grades improved,she is much more vibrant and happy. However, he now sent me a text stating he wants her back! She proceeded to call him and tell him no, and her feelings about what he did and how he did it and she stated she did not want to see him. He told her (I could hear him on the other end due to him being so loud)that he was coming to the school with cops and she WOULD go with him and the grandmother. This upset her so bad. I live in Florida and want to know do I have a case because he abandonded her and I don't feel it is in her best interest to go back to him. I know he is going to take me to court if I dont send her. I have all the text messages about how SHE treated him like crap and that was why he did not want her amymore. Please advise. Thank you.

YOu need to nip this in the bud. file a Petition for change of visitation, ASAP and serve him. Also have your daughter testify as to whether she wants to visit or not. She is old enough to make this clear to the court. They may restrict the visits to once a month, maybe even supervised or refuse to allow him to interfer at all.
