Legal Question in Family Law in Florida

my husband has been declared imcompetent and he walk out on his family hes not giving me any support. my question is, are he legal obligated to support his family and what are my chances of getting legal guardianship over his finances. he has been diagnosed with multiple dementia and he is living with another woman.

Who declared him incompetent? If he is and you have a letter from a physician then file for emergency guardianship and then guardianship. YOu will need to go to the mental health and file your petition with the court - an immediate letters of guardianship will be issued and then there is a process that the guardianship will take where three people from the examining committee will go out and check him and make a report to the court. If they find this is valid then a hearing will be held. An attorney will be appointed for his interests. I suggest you get going or the other woman will have all his assets andyou will have to file a suit against her to get them back if she has any assets to get.
