Legal Question in Family Law in Florida

If my ex husband is federally incarcerated (long term) since my son is 5 months old (he is now 10 years old)...What do I have to do for my son to change his name? He is wanting to have his name changed to my new husband's family name. Can we just change? Does he have to adopt him? Does my ex husband have any rights while a federal inmate?

Not sure if you need to know...but my ex husband has not attempted to contact my son in years. I have the same phone number, not one phone call. thank you in advance!

You can do a name change or a step-parent adoption or both.
