Legal Question in Family Law in Florida

My husband has filed for divorce and in the papers he has said that he only wants visitation every other weekend but he also said he wants to be able to claim her on taxes every other year. If he is only seeing her every other weekend can he legally claim her on his taxes?

He could if you allowed him to. You would have to file the appropriate paperwork with the IRS.

Only if you agreed to it. If he is reasonable on everything else, you might want to. If you both get along, you might want to have the Marital Settlement Agreement provide for both parties to run their taxes to see who would get the bigger benefit from claiming the child, and agree to equally split that benefit.

Since you have a child, it probably would make sense to retain an attorney to do this right.
