Legal Question in Family Law in Florida
My husband and I have filed our divorce ourselves, he refuses to move out, but won't pay for the mortgage if I move out, it has been 6 months. How can I get him out? Is it true that I can fill out a mental anquish type form at the court house to have him removed from the home? He constantly says he wishes I was dead, and other mean hateful things in front of my children. My other question is we let my 18 yr old son's girlfriend stay with us as her parents kicked her out about 3 months ago, now she is 18 and interferring with my other children and my ability to live in our house without undue added stress, my soon to be ex adds enough stress to the situation. My husband says she can stay as long as he does because he considers her a daughter and she has no where to go. The rest of the divorce forms will be in the court system tomorrow, then waiting for the case manager to call and date for final hearing.

What will you do when you get your final hearing and haven't settled the house issue? Is the house up for sale? How will you force him to pay the mortgage? Have your settled your issues, especially the division of the house, and is the settlement in writing?
You really need to talk to a lawyer and explain your entire situation and get some ideas on how to settle the house issue.
Also, so long as your husband is in the house and gives permission for the girlfriend to stay, you can't evict her, which is the only way to involuntarily get rid of her.
