Legal Question in Family Law in Florida

My husband filed for divorce September 1, 2016 but I was never served. We agreed to put a "hold" on the divorce and began seeing each other December 2016. He now wants to move forward with the divorce. The papers were filed in a different county from where I live. I have two questions:

1. Does a filing expire

2. Since it has been 9 months can I file in the county where I live?

depending on the county, the court may have closed the file for non-activity. He would have to pay a fee to reopen the file. Secondly, since you were never served, I suggest you move forward and file your own action. If he is a resident of the county you live in, you have the ability to do this.
