Legal Question in Family Law in Florida

Please Help!!

Husband and I lived in PA, and had a child born in PA. Husband convinced me to move to FL and into his parents home to save for a house of our own. Things aren't working out and my job can be transferred back up north to PA. I work fulltime, have all the medical, life insurance, etc for the three of us. Husband works PT not making much of anything. I want to move out of his parents home back to PA with my 2 year old son. We've lived in FL for 1.5 years and making no progress. I want to move in with my mother who has plenty of room, where as here in FL the three of us (husband, me and son) all share a tiny bedroom. My husband was okay with me leaving before, but now that I have positions open for me to move with my job he told me he will not let me move out of state with our 2 year old son.

Please help me. I can't get along with my husband anymore, and I just want to go back ''home'' where we belong. I don't really care to get divorced, I just want to leave with my son.

You are required to give him a notice with very specific language in it. He will have 30 days to object. If he does not object (by filing in court) you can move. You should really see an attorney about this because any mis-step will cost you the permission that you need.

You either need his consent or court permission to relocate with your child.
