Legal Question in Family Law in Florida

My ex husband got our marital home in our 2009 divorce and was to indemnify me per our marriage settlement agreement and final judgement. He was to refinance to take may name of mortgage and deed. Instead, he has walked away and not made a payment since Nov. 2009. Reflecting on past events, I believe him and his live-in girlfriend planned this as she bought a home in October, and he moved in with her. (they were living in our marital home). We both have been served foreclosure papers. I need to find out what my rights are and how to protect and defend myself. Also, what kind of attorney do I need...this seems complicated to me.

This is not unusual as many people who were granted houses as part of their divorce settlement are walking away from them. As your ex husband was given sole possession of the house and ordered to refinance the house in his name you should file a motion for contempt in Family Court. Unfortunately you also have to defend a foreclosure suit, you should contact their lawyer and try and work something out on your own.
