Legal Question in Family Law in Florida

My husband and I have been married for 5 years now and we have one 6 year old son together. A few months ago he received a letter in the mail being ordered to go to court for a paternity test. A women in another state was claiming he was the father of her child. He took the paternity test and he was the father of the child. She had never tried to contact him or let him know he had a child with her. The child is 12 years old, he took it as a shock that he has a child he never knew nothing about.

She is now coming after him for child support for her 12 year old. Clearly he is the father and should have to pay however does he have any rights in visiting the child, the mother does not want him to have any visitation just to pay child support.

The mother lives in Pennsylvania, and we currently live in FL.

We are struggling to make ends meet, cannot afford health care for us or our child, how can we afford to pay for another child, who he does not even get to see???

He needs counsel in PA. I would think he does owe child support and is entitled to some type of visitation in PA. This is a difficult situation.

This matter is controlled by Pennsylvania law, contact a PA attorney ASAP. Husband does have rights to see the child, PA law controls but the visitation may be in Florida.

He certainly is entitled to parent the child, however the child lives out of state so you have to file that case in the state where the child lives.
