Legal Question in Family Law in Florida
Is Husband Really in Nursing Home ?
My husband and I have not been living together since May, 2008. I live in one county of FL and he in another. I hired a lawyer back in July, 2008 and unfortunately being unemployed unable to financial keep up and am representing myself as of March, 2008. Prior to, there have been several postponements due to his and his lawyers neglect to follow through. April 8th we were to go to mediation and I have been informed it was canceled because he is now in a nursing home. I spoke with the paralegal yesterday because I have originally already put in a settlement that has not yet been answered. There are no children or assets only marital liabilities which should be shared. In asking what/where the nursing home he is in I was informed that information was able to be given to me. We are not legally even separated and legally he is still my husband. Can I get this? He was living with his parent's and his family will not communicate with me. Being I am representing myself, do I have the right to get this info or do I need to go through the courts to obtain? Thank you.

File supplemental interrogatories asking his current address and whether the current address is an ACLF or other type of nursing home. Reset your mediation. If he doesn't appear a second time, or if his lawyer refuses to schedule it with you, set your case for trial.
