Legal Question in Family Law in Florida

Me and my husband separated about 5 months ago, no kids, no property. We were ready to file for uncontested divorce. Now I am in new relation and expecting a child (not from my husband). How do we file for divorce now? can we still file for uncontested divorce? do i have to let court know i am pregnant?

You must absolutely let the court know you are pregnant. You may still file for an uncontested divorce.

You can still take the same steps for divorce that you were taking prior to your pregnancy. If your husband agrees with the divorce and the terms of the divorce then the matter can still be uncontested.

The court will need to know that you are expecting.

Your husband may need to disestablish paternity of the unborn child before the court will issue a final judgment in the matter.
