Legal Question in Family Law in Florida

My husband and I are currently separated and will soon be getting a divorce. We adopted a child thru the state and receive a montly check for her. She has lived with me the entire time that we have been apart but my husband has been keeping the montly check himself for the last 1-1/2 yrs. Is this legal? Is there something I can do, outside of taking him to court, to get the funds sent to me instead? I am trying to keep things civil and out of court as much as possible.

This check will factor into child support. If you primarily have timeshare with the child, you will receive the check and your husband will be responsible for any money owed under Florida's child support guideline's system above and beyond what the foster system (or other system) pays.

That money goes to you so when you file the divorce case please make sure you file a motion to have those monies re-directed to you. Contact my office for consultation 727-446-7659
