Husband and I and son live in FL we are married but want to move me and son to Michigan with my family. Can I do this legally. Will probably file for divorce later in MI

In answer to your question, I don't see anything wrong with relocating to another state for family, work, etc. You will have to be a resident of the new state for a Statutory period of time to be considered a resident of that state.

Generally, the best place to file for a divorce is in the county where you and your spouse last lived together as husband and wife. If you move to another state, you will most likely have to wait until you have established residency before the courts in that state would have jurisdiction.
If you are wanting to relocate with your child, you will need to comply with the provisions of Florida's relocation statute (Chapter 61.13001.) You should consult with a family law attorney in your area to discuss your options.
If there are no cases pending in Florida and no court orders in place, yes.
If you move to MI you will have to wait 6 months before you can file the case in MI.
