Legal Question in Family Law in Florida
husband says he will look for work as hard as I look for work which in his opinion is not too hard. I was away for the summer trying to clear up probate and house contents of my father who died in April, my hsband was supposed to help, but changed his mind three days after we got there and came back home. He has not paid bills all summer saying that he doesnt have the money or work coming in to pay them. I received some money form the insurance of my dad's estate, noot a lot but enough to pay the eletric, water, phone,, that were all past due. I am also getting money from a rrif and am going to use it to pay the mortgage back up to date. My car was repoed that didn't get paid also. I have been a stay at home mom for thirteen years and have a small home based sign/banner business . He blames me for not having a "real' job and says that if I let ths "ship sink" that he will never forgive me and make sure anything I do in the future will fail. I have not put any money into the bank account but have paid everythng cash. also says that if I bring in $500 per week he'll "match" it to help pay the bills. He has told relatives that he isn't going to try really hard to find work because I'm not trying to find any work. He has told me to leave the house and has asked why did I even come back from my dads home 1000 miles away. I told him because of the kids and their schools and I would not leave the house. - I have nowhere to go with three kids. What are my rights as far as, staying in the house, how much is he responsible for. How do I deal with the mortgage when he says my name is on it which I thought it was too, but when I call to find out if they can help lower payments, or even find out how much is due , they won't give me any information because the company says I am not on it and they won't give any answers. I asked him and he sad that he tried to get them to lower payments but because I don't have a job they won't help us . Is that true? I want ut of the marriage, and this house. want to start fresh and new but am afraid of what he will do to deter it.
As far as inheritence goes - do I have to disclose how much I will get in the future when probate is over?, do I have to share it with him, I plan to use it to pay off credit card debt and college for my kids, first. Should I get leagal separation papers before this? What are his responsibilities in regard to paying for the kids, bills etc?
