Legal Question in Family Law in Florida

My husband and I are wondering if an unrelated "Aunt and Uncle" can gain custody of two minor children. The parents are under DCF investigation, and the mother is going to prison for the 3rd time, and will be serving a minimum of 2 years. The father does not want the children, but refuses to give up his rights.There is a lot of abuse in the home and their other option is not much better. These children are the neices of my husband's step-father.

Yes - you can apply for guardianship of the children with the consent of the parents.
