Legal Question in Family Law in Florida

My husband's attorney is filing motion after amended motion for me to compel bank records my husband is still a signer on as a joint account. His lawyer is now trying to have me held in contempt for not producing them when it will cost me $5.00 per month to produce I have been declared indigent by the courts. He is also saying he has never received other documents regarding my income from disability, although he has received them. His lawyer has already gotten my husband out of 2 other mediations, now this will be the third due to this new delay and they are trying to get me to pay his attorney fees. What is the limit to all of this? My husband is working out of country for a US contractor for the military and he is trying to secure another job there that is not a US company and then he can disappear with no judgements so Korea will never enforce them. He knows this. What can I do? How can I get this to mediation so I can get SOME sort of court ordered judgment?

I am in Florida.

I'm assuming you are in the middle of a divorce. As far as court-ordered mediation, it appears that your husband's attorney is doing whatever it takes to delay the process, however with your husband out of the country that can be difficult. i recommend the option of 1) filing a motion to compel mediation date and 2) as to the discovery requests, you can file a response that you do not have the funds but that husband has equal access to the bank records as he is a signer on the joint account.

Sounds like you are getting jerked around and I suspect that you don't have a lawyer. You need one. The court can order your husband to pay your lawyer.

Follow the advise of m colleague Carmen Demapan. He has access to the records and he could retrieve those bank records as well as you. File that motion and compel the mediation ASAP.
