Legal Question in Family Law in Florida
Injunction and a minor child
I live in volusia county florida. I placed a permament injunction on the father of my 7 year old daughter. I was given full custody and the terms of the injunction state that the injunction will n ot be changed until the judge says so. The question is : My Husband has been offer a job out of the state we will live in currently ( Florida ). Is it considered kidnapping if we move? or do I need to file some kind of form. I do not want to let him know where we will be living. Thank You !

Re: Injunction and a minor child
Why? Is this a question about his visitation? You have custody of the child; you have the injunction against him so he cannot come around you. He is taking a job out-of-state. Now you do not want him to know where you are living. Problem is if you move out of Florida, another Court will probably not honor the injunction.
It is difficult to follow the question.

It is not considered kidnapping to move with your child. However, Florida law forbids you from moving the child more than 50 miles from your current residence without permission of the father or a judge. You should see a lawyer about the procedure, especially since you don't want the father to know where you'll be moving.
