Legal Question in Family Law in Florida

How can an inmate in a ny prison file for divorce if they were married in fl and she is currently in fl? They only lived in ny for about three months before he went to prison.

Just because a person is in jail does not mean they forfeit their rights to file lawsuits. Anyone can sue for anything. If she doesn't want to be in court in NY she needs to speak with a NY attorney about a Motion to Dismiss
