Legal Question in Family Law in Florida

I am currently in Iraq, fixing to start a divorce. Stationed out of colorado, my wife moved back to florida. She has my car and Im still paying monthly payment plus full coverage insurance. Can I get my car back when i get home?

Yes. Each spouse is entitled to a fair and equitable share of marital property. Spouses may agree to a marital settlement agreement which resolves all such issues. You would be entitled to the auto based on your facts unless there are other details or property which would affect the overall split of marital property.

If this is your only asset, perhaps. Are there children involved? If so, it may be her only transportation and therefore the court may award it to her.
