Jurisdiction of Minor Children
My son and his wife had a mediation hearing and they both agreed on certain terms. This never did go before a judge however. My son was tring to abide by the agreement as his wife left with the children for Virginia. After one month she had us pick up the children as she said she could not handle them ages 3 and 6. This was in February the mediation hearing took place in July. My son filed for a divorce here in Florida one month after she left. The children were born and raised here. She just picked them up for spring break and stated they are not coming back. Spring break is over and she pulled the 6yr old out of school for the second time in a year. What steps would my son need to take and could this also be considerd parental kidnapping.

Has a final judgment been entered by the judge incorporating the agreement or is the case still open and the parties only have this agreement? This would be good background information for me to have. This would determine which avenue that would be best for your son. Your son should seek counsel immediately on this issue.
