I have a 13yr and a 11 yr old who want to come back and live with me i have a stable enviroment for them now my ex refuses are they now old enough to talk to a judge about were they want to be they are misserable dads new girl friend drinks alot and son is a drug accdiacte they do not live with him but she is always around my daughter does not like the drinking and is always locked in her room to avoid her

Most judges think that 13 years old is too young for the child to be heard on where they want to live. I think all judges agreed 11 is too young. You should speak with a family lawyer to see if you have any chance of getting custody.
