Depending upon how she obtained the adoption by the step parent, she may have some serious problems. She may be receiving child support arrears from the biological father (which is not a problem and fully lawful), but if she is receiving ongoing support for children that were legally and appropriately adopted by the step father she is likely going to have to repay the support paid since the adoption was finalized.

I would agree with Tracy Newmark. Depending on the outcome of the case in family court, it would be up to the bio father to press charges for a criminal charge.
