Legal Question in Family Law in Florida

Can I leave State?

I am divorced and my daughters father has visitation rights. My daughter lives with me though. I am in a deep relationship and my boyfriend has had job offers to make more money in different states. Can I leave state with my daughter?

Re: Can I leave State?

You must first read your final judgment and/or marital settlement agreement to see if they address this issue. If they don't specifically state, then the law provides that you must get approval from your ex OR approval from the court and you must show that it is in the best interests of the child. A new visitation schedule should be drafted and the issue of travel and other expenses need to be addressed with respect to the visitation.
