legal advice needed

My husband would like to adopt my son. I have two guys that could be his biological father but one hasn't been in his life since I found out I was pregnant, and the other one told me to quit talking to him when he was 2 months old he now is 3 years old. Is it possible for me to only need one of the guys to sign the affidavit of nonparternity or do they both need to sign one? There is no father listed on his birth certificate and paternity was never established. Thank you

An affidavit of nonpaternity from both of them should work. The better procedure would be to determine paternity, then have the biological father sign a consent to adopt. But, if the judge is okay with it, your way is a lot easier. If not, you'll have to do it the long way (my way).
