Legal Fee's

I am a single parent, I never married nor resided with this man however, I resided in FL for 5 years, upon my decision to relocate back to NY the NCP filed an ''Establishment of Paternity'' along with a custody suit. The child was not born in FL she was born in NY and when she was born he signed a ''Voluntary Acknowledgement of Paternity'' which in NY by him signing that form it also Establishes the Paternity FL (Volusia County) stated that, that form was not sufficient to establish the paternity and allowed the NCP to proceed with his petition, this was in 08/03 In 06/04 I lost all my custodial rights, I have no visitation whatsoever with my daughter who has lived and been with me and her 2 older sibblings since birth.

I have been having a real hard time obtaining legal representation due to my financial situation, He on the other hand has a private attorney, I can not even get free legal aide because of a conflict of interest in his part he used their services in the past and now I am not able to attain their services he wont even sign the waiver of the conflict of interest. I do not have the resources to hire an attorney. I was told that since he brought the action then he is to pay for all legal fees involved, Is this true?

Only if the court orders it. I doubt any attorney would take on such an important matter without a guarantee of payment.
