Legal Question in Family Law in Florida

Legal paperwork needed - care of grandchild

My adult daughter is moving out of state and my 16 year old grandson wants to stay here in Florida with me. What legal paperwork do I need to have to cover medical, school, etc...? What legal forms are needed andwhere would I find them?

Hello, this is in response to your question re: your grandson. This situation comes up often. I can mention two possible remedies. You did not mention the child's father, so I can only give a general answer.

One remedy is to seek a court order pursuant to Florida Statute, sec. 751. You may want to review this on line. This grants temporary custody of a minor to an immediate family member. This can be terminated at the request of either parent. That court order would be recognized by school officials, insurance providers and medical service providers.

The other option is to obtain a Power of Attorney from your daughter to you. This allows you to sign documents on her behalf. I have prepared one of these for a grandmother at her request. There could be a problem as to whether an insurance provider for grandmother would consider the grandson a member for coverage. If you desired to try this option, I would contact your insurer first to see if that would satisfy their requirements to have the child covered.

'Hope this helped. Tom Rosenblum
