legal seperation

When you get a legal seperation from your spouse do you still have to file income tax together. My husband makes more money than me does he have the right to claim our son.

If you and your husband can not work out the marriage and are desiring a separation then have you considered divorce. While separated, issues arise all of the time. For example, new debts, child support with no agreement, new assets, who claims child on tax. These issues and more crop up and need to be addressed. Therefore, settle these issue and anything else and file for a divorce. If the two of you are considering working on the marriage then I am all for that. Seek counseling if you feel that would help. But if the marriage is over then file and move on.
