My ex wife has recently divorced her 4th husband (I was #3), and she is back to using my last name instead of her last married or her maiden name. Is this legal?

We have an 11 year old son which I have coustody of with my last name, does she now, or could she ever gain the right to acquire and use my last name again.

If her divorce decree includes a change to a prior name provision, she can use your last name. I assume your last name was hers prior to marriage #4.
