Legal Question in Family Law in Florida

Can I legally leave the state with my daughter if there has been no legal proceeding whatsoever in regards to custody? He was (is) listed as the custodial parent in a child support case ( that was only open with an administrative order following an application for state benefits) She is in my care and the deputy sheriff i spoke with couldnt say but he thought it sounded ok. the child support enforcement agency also let me know that his status as custodial parent does not grant him legal custody.
