who gets legel custody of miner child if parents never married in florida and minor lives with you and the father doesnt pay child support

Mother always has legal custody - never married. If you want child support then you need to provide proof of paternity (if the other party request it) and file for child support.
Just be aware that once you do this - the other party will request visitation rights or may do so at any time - especially if his name is on the birth certificate.
