Legal Question in Family Law in Florida
I live in Florida and have had custody of my teenaged daughter for 3 years after my ex dumped her at my door. My ex has paid some child support but also missed many months. She is under no order to pay. I filed to domesticate an out of state divorce, child support etc. and she has filed a motion to dismiss but her motion came after the 20 days from date of service. My daughter turns 18 in September and starts college in August. In the mean time we've lost our home and are sleeping on a friends couch... car insurance has been cancelled, cell phones cut off etc. and since my filing for past due support my ex has stopped all payments. How do I ask the judge for an emergency hearing? How do I respond to the motion to dismiss? I need help because we're really desperate!

Your ex is merely trying to do delay the process. Have you tried going to the child support enforcement office bc it sounds like you would qualify for their assistance in your case. You should request a hearing on both your motion to domestic final judgment of dissolution of marriage and also your ex's motion to dismiss. Your question doesn't provide the reasons for the Motion to Dismiss, ie language in the Motion. You have enough support for your argument to domestic the final judgment on the basis of your child residing with you in Florida as well as yourself being a resident here and having strong ties to the area. Good luck!
