Legal Question in Family Law in Florida

I live in Florida & my daughter had turned 18 on 12/01/2011. Since she is still attending HS & will be graduating in 05/2012, can the Father sign an agreement to continue making payments as opposed to the Dept. of Revenue taking the matter to court? This would take several months thru the courts. In the meantime, the DOR are continuing to take payments from his pay & I was told they are holding the child support until the courts extend the payments. If the Father is in agreement, I'd be able to receive the now past 4 payments that are being held by the DOR. Thank you.
