Legal Question in Family Law in Florida
I live in Florida and the mother of my children live in Virginia. We have joint legal custody and she has physical custody. She has not been providing a safe enviroment for our children and is not holding up on her end of the deals that we have made. How do I go about trying to get custody of the children ?

If your case needs to be filed in Florida, you'd file a Supplemental Petition for Modification of Timeshare and Parenting Plan, but it sounds like your case needs to be filed in Virginia. Normally, custody cases need to be filed in the state where the child lives. There are some exceptions, though. Try to talking to a Virginia lawyer to find out if you should file there and, if so, what type of lawsuit you should file.
