Legal Question in Family Law in Florida
live-in
My ex husband is taking me to court for custody of our two children. A lot of the allegations are untrue. The question I have is, the man I am now engaged to lives with me and my children. Will this cause a problem with me winning the case?
I have already won a custody battle with my ex husband almost 4 years ago.

Re: live-in
Based on your question it sounds that you have been served with a Petition to Modify Custody. If that is the case, then you must file an answer within 20 days of that service. You stated that the allegations are untrue, therefore, be sure you address those allegations in your answer. You should have an attorney handle this to prevent you from losing your children. Finally, you living with someone should not hurt your case, unless there are some facts that indicate harm to your children. The Judge will be looking at the best interests of the children, their health, happiness and well being.
