This is really a landlord and tenant question not family law. You need to give your former boyfriend formal notice to vacate the premises at least 15 days prior to the first day of the month. If he fails to vacate, then you must file an eviction suit against him just as if he was a tenant who did not pay rent.

Be sure to set forth the nature of the relationship and the fact that he has not signed the lease. Let the court know what rent he has paid, if any.

It would be wise to consult a local real estate attorney to review the specifics of your matter and to be sure you handle it properly.
