Legal Question in Family Law in Florida

I have been living with my boyfriend for 3 years. My ex-husband hates him because my son loves him. Now the ex wants to use the boyfriend's criminal past against me. Boyfriend has a felony for habitual driving on a suspended license more 10 years ago (has his valid license now), and a domestic violence charge around the same time. The ex is currently on probation for violating a restraining order I have on him. What kind of influence can the criminal history have on a custody modification? I should also point out that my boyfriend has sole physical custody of both his kids.

Better yet, you might want to consider retaining an experienced family law attorney.

The fact that the convictions were over 10 years ago, plus the fact that he has been awarded "custody" of his own kids, should all be brought before the Court.

In Florida, with family law cases, depending on the parties' comparative financial resources, the Courts have the discretion to hold one party responsible for all, or part, of the other's attorney fees and costs. In other words, if the other party has significantly stronger financial resources, while you will still have to pay the retainer, do not assume that you will not be able to afford to retain an attorney. Reimbursement can be sought.

If you opt to proceed without the assistance of counsel, be aware that you will not be entitled to a �do over� if things go badly.
