Legal Question in Family Law in Florida
I am living and working with my "boyfriend" we manage a business together which can cause alot of strain on our relationship. We have a 9 month old daughter together. Three weeks ago there was a domestic disbute in which I called the police. After listening to my boyfriend who mind you is 17 years older than me I went to his lawers office and wrote a letter to the DA retracting the statement I had told the police. Thinking that we would try to work out our issues and keep our wonderful job, problems are continuing. He is now threating me with the fact that I retracted my statement and saying he will put me in jail and take away my child. I am very confused and have never delt with the legal system AT ALL. I was also diagnosed with post partum depreesion after the baby and he is threatening me with that aswell. I am a wonderful mother to my child and he just has a great way of scaring me. I want to make sure I can back myself in a bad situation and know what to do. Please help me understand what steps need to be taken. Thank you - Ashley

It would appear that this is not a marriage. Therefore unless he sues you for paternity and rights of visitation. you can sue him for child support without the necessity of visitation.
As to the business - you have nothing. Florida does not acknowledge common law marriage and he can kick you to the curb because I am sure it is NOT in your name.
Leave this guy and get a restraining order on him and refile at the Domestic Violence. Tell them why you did the retraction "that you were in fear of your life and your childs" and believe me they will help you.
