Opening an estate will depend on several factors - one main one is there a will. If so, it should be filed - if - there is a need to probate. If there is no real estate to be homesteaded, there will probably be no need to probate the will. You can certainly file for probate and demand that a Will be produced IF you are a descendant of the decedent. If you are related to the decedent, you may have standing if you are a child of the decedent. If you need assistance, please contact my office for an appointment 904-997-1031
