just would like to know how long after someone death, can you open a case and sue the estate due to findings in a will

Opening an estate will depend on several factors - one main one is there a will. If so, it should be filed - if - there is a need to probate. If there is no real estate to be homesteaded, there will probably be no need to probate the will. You can certainly file for probate and demand that a Will be produced IF you are a descendant of the decedent.
