Legal Question in Family Law in Florida
magistrates power
My boyfriend's ex wife filed for a divorce in July 2007. They have been to court 3 times and it is not resolved. The issues unresolved are flexible custody( he is a retail manager so his schedule fluctuates quite a bit) and the house. He is paying $200.00 a week in child support. She is refusing to sign the final judgement paperwork. His lawyer met with the magistrate on the case last week and she ordered his lawyer to listen to the tapes and type up the final judgment paperwork that she agreed on last time they went to court and send it to her lawyer. She is still refusing to sign. Will the magistrate eventually sign off on the paperwork and finalize everything? We are trying to buy a house and eventually get married. The ex wife's attorney just withdrew from her case because she does not cooperate with him. There is a child involved. My bf's attorney just filed a contempt motion because she is not allowing my boyfriend to see the child. How long will the contempt motion take to get discussed?

Re: magistrates power
You will have to talk to your bf's attorney to see if he got a date for the contempt motion. The judge can not just sign off on a divorce, if there is no settlement agreement between the parties. The matter would be set for trial.
