Legal Question in Family Law in Florida
Marital
Can I personally sue the woman my husband was having an affair with if after theiy broke up she continues to call and text and e mail even though we have both told her to stop she is married too. May I also add that I have an illness and this has made it worse.

Re: Marital
I think your husband will need to get a restraining order against her, which he could then ask a court to enforce it if she doesn't comply with it. But there is an obvious question: Will your husband agree to do this. If not, then a judge will wonder if your husband isn't facilitating things for this other woman.

There is no cause of action under Florida law unless your husband cares to claim harassment and he might be able to file a domestic violence complaint and restraining order issued but it is unlikely.

So far I have not heard of any grounds for a lawsuit, but possible such could eb the case with more deatiled facts. You might be able to obtain a restraining order.
