Is the marriage legal?

I was married in 1995 in miami, FL, and had a son a year later. We seperated in Jan 2002 and I relocated to Indianapolis with my son in August. I have found out that he is still married to his first wife, he never obtained a divorce. Is the marriage legal and if its not do I have to obtain an annulment to be done with him. And can he get a court order to have us return to miami?

Unfortunately, you have so many circumstances that I would suggest you consider making an appointment with an attorney. Even though your marriage be void or voidable since he never obtained a divorce from his first wife, the fact that he is the father to your child gives him rights, irrespective of whether you are married.
