Legal Question in Family Law in Florida

In a second marriage my wife and I lived together a total of 11 months. We were married for 23 months the time between the date of marriage and her filing the Petition for DIssolution. Her MSA is asking for 1/2 of the my 401k about 16k while we were married. We bought a home together, during the marriage, that has about 40k in negative equity. I am asking for the negative equity to be included in the equitable distribution worksheet. Her attorney refuses to include it. Can I expect a judge to allow a setoff in the amount of the negative equity against the 401k? I have an appraisal to back up the negative equity in the family home.
