I am married but I had a baby from another man and he has served me with custody paper. What from should my husband use to claim my child is legally his child and he wants to keep her.

If you were married at the time your child was born, the bio dad has no standing to interfer or claim this child. The law is very clear on this issue. If I can be of assistance, please contact my office for an appointment.

A child born during a marriage is presumed a child of the marriage so it is very difficult for the biological father to intervence, although current Florida Law may give him a small opportunity to assert his rights. Contact my office for free consultation.
